We reserve the right to modify, add, and/or delete the conditions in whole or in part at any time, at our discretion, without prior notice.

The use of this website implies acceptance of the following Terms and Conditions. If you do not agree with these terms and conditions, please refrain from using this website or contact us if you have any additional questions.

The nullity or illegality of any provision of this contract shall not affect the validity, legality, and enforceability of the remaining provisions.

  1. I) GENERAL INFORMATION

The owner of this website is PRODUCCIONES TURÍSTICAS QUETZAL STONE S.R.L. (hereinafter The Company), a company incorporated under the laws of Costa Rica, with corporate identification number 3-102-892303.

Our company specializes in the development of recreational, holistic, expedition, domestic and international tourism experiences. We are an accredited company before CANATUR (National Tourism Chamber of Costa Rica) with extensive experience.

  1. II) DEFINITONS
  • “Company” refers to PRODUCCIONES TURÍSTICAS QUETZAL STONE S.R.L.
  • “Website” refers to quetzalstone.com website.
  • “User” refers to any individual accessing or using the website.
  • “Client”, “traveler” or “guest” refers to individuals who acquire any service provided by the company.
  • “You” and “your” refers to individuals who acquire any service provided by the company.

 

III) CUSTOMER SERVICE

To facilitate the prompt and effective resolution of any complaints, questions, or concerns regarding the services offered, the Company provides customer service through the following contact information:

III) SERVICES

 Through the website, users will be able to find information about tourist programs, experiences offered by the Company and request quotes for custom travels. The services included in each program or package are those specified exclusively in the submitted offer.

  1. BOOKING CONDITIONS:

Before booking a custom travel or any of the programs we offer, we require a virtual meeting to understand your travel needs. Alternatively, we will send you a form with the information we need to provide the desired service.

To proceed with a reservation, you must submit payment confirmation and any requested documentation. By doing so, you confirm your full and unconditional acceptance of the terms and conditions outlined in this document and any accompanying annexes provided by us. You also confirm that you have the mental and legal capacity to enter into a contract. The purchase of our services is non-transferable and may not be assigned to any other person, unless otherwise specified.

  1. COSTS

All prices outlined in the contracts (quotes) are net and must be paid in American dollars (USD) unless specified. Prices are subject to change, and quotations are valid for a maximum period of 15 business days. Our prices include:

  • Only the services explicitly mentioned in the program any other service not explicitly mentioned in the program or offer is excluded from our prices.
  • Accommodation: those mentioned in the itinerary or similar, subject to av room availability and client approval.
  • Meals: Those specified in the program (B = Breakfast, L = Lunch, D = Dinner).
  • Transfers: As indicated in the program.
  • Baggage: For all purposes, it will be understood that the user’s luggage and other personal belongings are kept with them, regardless of the part of the  vehicle in which they are placed, and that they are transported at the user’s 
  • Taxes and entrance fees to attractions: This includes hotel taxes, tickets to National Parks, Conservation Areas, Museums, and other specified places of interest as specified on offer.
  • Tours or excursions: As specified in the program.

Not included in our prices: 

International flights, insurance and security deposit of the rental car (unless  otherwise specified); cost of obtaining visas, passports or tourist cards;  airport taxes, and / or entry and exit fees, vaccination certificates; personal  expenses such as tips (except in cases where they are specified); charges for  excess baggage; meals and visits not specified as included in the program;  food and beverages, “extras” such as coffees, wines, liquors, mineral waters,  special diets – not even in cases of full board or half board, unless otherwise  expressly agreed to in the contract; communication expenses; travel  insurance (The Company requires travelers to arrange their own insurance coverage for every trip); medical expenses, bonus to guide or  driver; expenses for excess baggage; optional hotel services, such as  washing and ironing clothes, and, in general, any other service that is not expressly included in the section “The price of the trip includes” or is not  specifically detailed in the program / offer, in the contract or in the  documentation that is delivered to the user when subscribing. 

  1. PAYMENT POLICIES
  • For Signature Experiences for FIT’s: 1-9 Travelers

For Signature Experiences inquiries for groups from 1 to 9 travelers, a non-refundable deposit of $150 is required for the creation of a personalized itinerary. This deposit will be deducted from the total cost in the event of purchase completion. Should the client choose not to proceed with the travel package, the $150 deposit will not be refunded. 

After making the $150 deposit, a detailed discussion will be held with the client to address all relevant aspects for designing the itinerary. Subsequently, a video call will be scheduled with a Quetzal Stone Experiences agent, who will provide a comprehensive explanation of the itinerary designed by the Company. Finally, a confirmation email will be sent containing information on the services for participant approval, along with details of the required reservation fees for the program, as outlined below:

***For arrival dates between December 18 and January 5 of the following year and Easter Week, the final payment of the trip must be completed 65 days before your arrival. 

 

  • For Signature Experiences for Groups of 10+ travelers

For Signature Experiences inquiries for groups fo 10 or more travelers, a non-refundable deposit is required for the creation of a personalized itinerary:

– $500 for itineraries of 7 days or less.

– $800 for itineraries of 8 to 14 days.

– $1200 for itineraries of 15 to 21 days.

– For itineraries of 22 days or more, request a quote.

This deposit will be deducted from the total cost in the event of purchase completion. Should the client choose not to proceed with the travel package, the non-refundable deposit will not be refunded. 

After making the non-refundable deposit, a detailed discussion will be held with the client to address all relevant aspects for designing the itinerary. Subsequently, a video call will be scheduled with a Quetzal Stone Experiences agent, who will provide a comprehensive explanation of the itinerary designed by the Company. Finally, a confirmation email will be sent containing information on the services for participant approval, along with details of the required reservation fees for the program, as outlined below:

We suggest planning your group travel at least 6 months in advance. For arrival dates between December 18 and January 5 and Easter Week, we suggest planning at least 1 year in advance.

PAYMENT METHOD:  The payments can be made through bank transfers to the bank accounts provided in the offer or via secure payment links.

The payment policies for the FIND YOUR CENTER experience are as specified in the terms and conditions of the program.

  • CHANGES TO THE ITINERARY

Changes to the itinerary, including adjustments to dates, activities, accommodations, or other services, are subject to approval and availability from each of our service providers involved in the original itinerary. Once a change request is submitted, the Company will promptly contact the service providers to confirm availability and any associated charges.

If the requested change results in a price increase, the traveler will be responsible for covering the difference in cost. Please note that change requests to the itinerary must be submitted no later than 65 calendar days prior to the travel date during high and peak season (January 3 – April 30 / July 1st – August 31st / November 1 – December 21 / December 22, 2024 – January 2, 2025 and Easter week), and up to 35 calendar days prior during low (May 1st – June 30th and September 1st – October 31st). Any change requests made after this deadline will result in a 100% cancellation penalty.

Should the original itinerary include a non-refundable reservation, an additional payment may be required upon rebooking. It’s important to note that travelers are allowed to request changes to the dates of the itinerary only once; additional changes beyond this initial request are not permitted.

Travelers may add additional services or experiences at any time without penalty, subject to availability and payment of the additional charges.

  • PROGRAMS AND EXPERIENCES

The Company is committed to enhancing trip itineraries, services, and amenities. If improvements can be made, or if circumstances beyond our control require changes, we reserve the right to modify itineraries, substitute accommodations, and adjust activities. This includes the right to replace or substitute accommodations, modify the order in which places are to be visited, and make other changes to the itinerary. You acknowledge that the amenities, accommodations, transportation, route, schedule, and other aspects of the itinerary may change without prior notice and without compensation/refund. If, prior to departure, we make a significant change under this paragraph, we will, as soon as reasonably possible, notify you of available alternatives.

Please note that certain activities may not be precisely as described or may not be available due to weather conditions or other circumstances beyond our control.

If we are compelled to reschedule, postpone, or cancel your trip due to reasons entirely within our control, whether before or during your itinerary, we will promptly notify the travelers. In such situations, we may, at our discretion, provide one or more of the following options: a credit for the itinerary price, the opportunity to rebook a comparable itinerary, or a refund.

We strongly advise our travelers to obtain travel insurance, to mitigate such circumstances. Please note that adjustments, modifications, postponements, or rescheduling of your trip, or offering a travel credit, do not constitute a cancellation of the itinerary by us.

  1. CANCELLATIONS

Cancellations must be communicated in writing at least 30 natural days prior to the travel date during low season and at least 60 days prior to the travel date during high season. In such cases, a handling fee of $250 USD per person will be applied, along with any non-refundable deposits, monies, and cancellation fees paid to suppliers and third parties for trip components, which are subject to our providers’ cancellation policies.

If the traveler cancels or postpones the trip with less notice than previously described, the following cancellation charges apply:

HIGH SEASON (January 3 – April 30 / July 1st – August 31st  / November 1 – December 21) & PEAK SEASON (December 22, 2024 – January 2, 2025 and Easter week)

 

  • Between 31 and 59 days before arrival, we charge a penalty of 50% of the booking cost.
  • Between 15 and 30 days before arrival, we charge a penalty of 60% of the booking cost.
  • 14 days or less before arrival, we charge a penalty of 100% of the booking cost.

LOW SEASON (May 1st – June 30th and September 1st – October 31st)

 

  • Between 15 and 30 days before arrival, we charge a penalty of 50% of the booking cost.
  • 14 days or less before arrival, we charge a penalty of 100% of the booking cost.

 

FORCE MAJEURE EVENTS

In the rare circumstance of trip cancellation due to any force majeure event, we will reschedule and provide updates on new dates. The additional cost or loss caused will be the responsibility of the client. No refunds will be made for services, accommodations, food and transportation not used. No money will be returned once the trip has begun.

In the event that a traveler cancels or postpones their trip outside the specified timeframe outlined in the aforementioned cancellation clause, but due to force majeure events, the cancellation policies of accommodations and other service providers will be enforced. However, if the cancellation occurs after the trip has commenced, no refunds will be issued for any unused portions of the itinerary. The expenses accrued during the trip, as well as the costs associated with the originally contracted services, if any, will be the responsibility of the traveler.

We advise our travelers acquiring flexible airline tickets to safeguard their investment in the event of travel date changes. Force Majeure Event means any event or circumstance beyond the control of the Company, including but not limited to: earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning or natural disaster); acts of terrorism, political unrest, war or threat of war, riots or civil strife; pandemic, epidemic or health risk; governmental and administrative actions (including closure of borders and travel warnings and restrictions).

  1. VISAS AND ENTRY REQUIREMENTS

All countries require a valid passport (with a minimum 6 months validity). Travelers should contact their local embassy or consulate for the most up-to-date visa requirements, or consult their travel agent. It is the responsibility of each traveler to ensure they have the correct travel documentation, such as visas, vaccinations, taxes, etc., required for entry into Costa Rica. Visa requirements for the trip may vary depending on the traveler’s country of origin and destination. Children under 18 must have written permission signed by their parents or guardians,  in anticipation that it can be requested by any authority.

It is essential that travelers verify the requirements information independently and acknowledge that they are solely responsible for obtaining and carrying their visa, as well as any other entry requirements.

Travelers bear sole responsibility for any delays, damages, and/or losses, including missed portions of their vacation, related to improper documentation or government decisions about entry. The Company assumes no responsibility for such circumstances. Also, if you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made.

  1. INSURANCE

Due to the nature of the experiences we offer, it is mandatory for all travelers to have valid medical insurance coverage to safeguard them in the event of accidents, illnesses, or unforeseen circumstances. This insurance should include coverage for personal injury, illnesses, death, medical expenses, hospitalization costs, repatriation expenses, and emergency evacuation expenses. Please ensure that your insurance policy covers all activities you plan to participate in.

The choice of insurance provider is left to the discretion of each traveler. We strongly recommend that your insurance also includes coverage for cancellation, personal liability, and loss or theft of personal property.

The Company has the right to refuse travelers without the required insurance cover to join our trips. The Company is not responsible for any health incident, accidents loss or theft of personal property that may occur to travelers during the travel program.

  • MEDICAL CONDITIONS AND SPECIAL NEEDS

We recommend you consult your doctor before traveling. We rely on your assessment of your own ability to participate in this experience. Please also promptly inform us in writing in the event of any significant changes to your mobility, any other disability or medical condition after your booking has been confirmed.

Some experiences involve outdoor activities and/or can be physically demanding, you must make your own decisions about experiences and participate only in activities that suit your physical ability. All activities which you undertake during your trip are at your own risk (including but not limited to: Swimming, hiking and surfing.)

Any dietary requests, special meal requirements including allergies or any other special request, must be provided at the time of booking and are received on a request basis only.

  • BEHAVIOR

We do not permit the use of drugs of any kind and/or excessive alcohol consumption in any of our trips. We reserve the right to remove any traveler engaged in such practices.

Additionally, to ensure the safety and well-being of all travelers, we strictly prohibit any form of abusive or aggressive behavior towards our staff, suppliers, or fellow guests. Such behavior includes but is not limited to:

  1. Verbally abusive language,
  2. Inappropriate or aggressive behavior, such as unwanted physical contact, harassment, violence, or threats of violence,
  • Possession, carrying, or use of dangerous items, including weapons,
  1. Engagement in illicit or dangerous activities that violate company policies or national legislation.

Any traveler found engaging in any of the aforementioned behaviors may have their vacation terminated by The Company representatives. In such cases, full cancellation charges will apply, and no refunds will be issued. Additionally, we will not be liable for any expenses incurred by the traveler, including alternative accommodation and return transportation arrangements, as a result of the termination of their travel arrangements.

 

  1. RESPONSIBILITY

The Company operates as an author and a tour operator, serving solely as an agent on behalf of the traveler regarding the trip. To the fullest extent allowed by law, the Company will not be held accountable for cancellations, actions of other service providers, changes in equipment, or any act, modification, delay, exclusion, or failure by ground transportation providers, hotels, transportation companies, or any other individuals offering services or accommodations to guests, including any resulting effects such as alterations in services, accommodations, or facilities.

The Company bears no responsibility for any claims, loss, deterioration, or misplacement of luggage or personal belongings of the traveler; delays, inconveniences, frustrations, distress, or lack of enjoyment, whether physical or mental, caused by (1) actions or omissions of third parties other than the Company or its employees and collaborators; (2) mechanical failures, governmental actions, strikes, protests, atmospheric or climatic conditions, natural phenomena, or any other factor beyond our control; (3) inability to obtain documents, passports, visas, and health certificates valid at the date of entry into the country, if required, in which case a cancellation fee will be applicable; (4) inability to comply with provided instructions, including, but not limited to, entry times, departure times, check-in procedures at hotels, services, excursions, airports, or any other instructions related to the care of luggage and other personal belongings of the buyer and/or traveler; (5) cancellations or changes of any kind in travel services offered; (6) medical or health problems or physical disabilities.

 

Domestic air transport is included only at the request of the traveler. The Company does not assume any responsibility for cancellations, delays, overbookings or any loss of service caused by it.

The Company reserves the right to cancel a tour or any part thereof if it is deemed necessary for the comfort and well-being of the participants. In such cases, the Company will not assume additional costs or losses resulting from delays or events beyond our control. Such losses will be borne by the travelers.

Travelers who choose to take part in our vacation programs do so at their own risk. The Company shall not be held responsible for injuries, expenses resulting from damages, and/or costs arising from accidents or accidental death during the trip.

Many of the activities included may not be suitable for individuals with serious health issues, pregnant women, mental or physical disabilities, or those unable to participate in activities such as surfing, or extended jungle treks. It is the responsibility of the traveler to assess the suitability of these activities organized as part of the trip based on their physical and emotional capabilities.

The traveler is obligated to inform us of all relevant personal circumstances (such as age, chronic illnesses, disabilities, etc.) that could impact the smooth execution of the organized trip. The Company shall not be held liable for the loss of international flights or transfers to and from the International Airport upon arrival in Costa Rica or departure, resulting from erroneous or incomplete flight information provided by the participant to The Company.

The traveler is responsible for verifying that the times indicated in the confirmation of services and vouchers for transfers to and from the airport align with their flight schedule.

We will not provide refunds to individuals who, through their own choice, responsibility, or oversight, opt not to utilize any or all of the services outlined in the trip. In cases where such modifications entail an additional fee, the client will be responsible for covering the associated costs.

  1. AFFILIATE PROGRAM:

Our affiliate program is aimed at travel agents, experience designers, and group leaders. This initiative provides them with the opportunity to collaborate with us by promoting our ‘Find Your Center’ program to their client base and earning commissions for generated sales.

How it works:

  1. Promote “Find Your Center”: Actively market our travel program to your clientele. Utilize our provided graphic materials for effective promotion.
  2. Encourage Interested Clients To Schedule A Call: Provide your clients with our exclusive Calendly link, custom-created for your agency, to schedule a call with us. Ensure they understand the purpose of the call and the potential benefits of participating in “Find Your Center.” This link is personalized and created specifically for your agency.
  3. Our Program Orientation Call: The Quetzal Stone team will conduct a video call with the interested client to thoroughly explain all aspects of “Find Your Center” and facilitate the sales process if they express interest. Your attendance on the call is welcome.
  4. Receive an email on the same day after the scheduled call with a report, informing you of completed reservations.
  5. We’ll send a final report after May 1st,2024 with all confirmed sales and corresponding commissions. We’ll then make a deposit by May 10th, 2024, after all clients have completed full payments and we have settled payments with all suppliers, transferring the total commissions earned to your bank account.

Referral fees:

1-2 pax: 8% commission per person referred.

3-5 pax: 10% commission per person referred.

6+ pax: 12% commission per person, or one agency representative travels free (CPL) under the same conditions as guests, including all details outlined in the “Find Your Center” Terms and Conditions. The agency representative may choose between earning the commission or taking the trip.

The commissions are allocated exclusively to your travel agency for the sale of the Find Your Center program to your referred clients. These commissions are not granted for:

  • The purchase of optional tours acquired by the client during the duration of the program.
  • The purchase of additional services outside the program for client’s extended stays in Costa Rica.
  1. IV) INTELLECTUAL PROPERTY

All intellectual property rights related to the content and design of this website, including but not limited to texts, images, graphics, logos, videos, software, and other elements, are the exclusive property of the Company or its licensors, and are protected by applicable intellectual property laws. Any reproduction, distribution, modification, or unauthorized use of such content is strictly prohibited, except with the prior written consent of the Company. The use of the website or services offered through it DOES NOT grant the user/client authorization to reproduce, modify, commercially exploit, or in any way disseminate the digital content, distinctive signs, images, and other information contained on the Website, without the express consent of the Company.

  1. V) PRIVACY OF INFORMATION

To use the services offered by The Company, users and/or clients must provide certain personal data. Their personal information is processed and stored on servers or magnetic media that maintain high standards of security and technological protection. For more information regarding this matter you can consult our privacy policies.

  1. VI) JURISDICTION AND APPLICABLE LAW

These terms and conditions are governed in all respects by the laws in force in the Republic of Costa Rica. Any dispute arising from this agreement, its existence, validity, interpretation, scope, or compliance, shall be submitted to the competent courts of the city of San Jose, Costa Rica.
